These Terms of Service ("Terms") govern your access to and use of CaptionPro, a service provided by OptimizeSocial ("CaptionPro," "OptimizeSocial," "we," "us," or "our"). By creating an account, purchasing a subscription, or using CaptionPro, you agree to these Terms.
1. CaptionPro Service
CaptionPro is an artificial intelligence-powered tool designed to help users generate social media captions based on information provided by the user and, where applicable, content and data associated with social media accounts.
CaptionPro currently supports certain social media platforms identified within the service. Platform availability and features may change over time.
CaptionPro is an independent service and is not endorsed by, affiliated with, or sponsored by any third-party social media platform unless expressly stated otherwise.
2. Free Generations
CaptionPro may allow new users to generate up to three caption generations at no charge before purchasing a subscription.
No payment is required for these free generations unless otherwise clearly disclosed before use.
Free generations have no cash value and may not be transferred, resold, or combined across accounts.
We may modify, limit, or discontinue free generations at any time.
3. Subscriptions and Billing
Paid access to CaptionPro is offered on a recurring subscription basis at the price displayed at checkout.
Unless otherwise stated, subscriptions are priced per connected social media account.
Before purchasing, you will be shown the applicable price, billing frequency, included usage, and other material subscription terms.
By purchasing a subscription, you authorize us and our payment processor to charge your selected payment method for the applicable recurring subscription fees until you cancel.
Your subscription automatically renews at the applicable billing interval unless you cancel before the next renewal date.
Prices may change in the future. Any price change will be communicated and implemented as required by applicable law.
4. Usage Limits
CaptionPro subscriptions may include limits on the number of caption generations, captions, connected social media accounts, or other features available during each billing period.
Your current usage allowance will be disclosed within the service or at the time of purchase.
Unused generations or usage allowances do not roll over to future billing periods unless we expressly state otherwise.
You may not circumvent usage limits, create multiple accounts to improperly obtain additional free usage, use automated systems to generate excessive requests, scrape the service, or otherwise use CaptionPro in a manner that interferes with the service or imposes an unreasonable burden on our systems.
We may apply reasonable technical safeguards, rate limits, and anti-abuse measures.
5. Cancellation
You may cancel your subscription at any time through the cancellation method provided within CaptionPro.
Cancellation prevents future renewal charges. Unless otherwise stated or required by law, you will continue to have access to your paid subscription through the end of the billing period for which you have already paid.
Deleting CaptionPro, disconnecting a social media account, or ceasing to use the service does not necessarily cancel your subscription. You must complete the designated cancellation process.

6. Refunds
Except where required by applicable law or expressly stated otherwise, payments for CaptionPro subscriptions are non-refundable once charged.
We generally do not provide refunds or credits for:
- partially used billing periods;
- unused caption generations;
- failure to use the service;
- dissatisfaction with AI-generated content;
- forgetting to cancel before a subscription renews; or
- cancellation after a renewal charge has already occurred.
We may, in our discretion, issue refunds or credits for duplicate charges, billing errors, significant technical failures, or other exceptional circumstances.
Nothing in this policy limits any refund or cancellation rights that cannot legally be waived.

7. AI-Generated Content
CaptionPro uses artificial intelligence and automated systems to generate content.
AI-generated content is probabilistic and may sometimes be inaccurate, incomplete, inappropriate, offensive, misleading, repetitive, unexpected, or otherwise unsuitable for your intended purpose.
You are solely responsible for reviewing, editing, approving, and deciding whether to publish or otherwise use any content generated by CaptionPro.
We do not guarantee that generated content will:
- be factually accurate;
- achieve any particular level of engagement, reach, followers, sales, revenue, or other performance;
- match your personal preferences or voice perfectly;
- be appropriate for every audience or circumstance;
- be free from errors or potentially objectionable material; or
- comply with every law, regulation, platform policy, professional standard, or third-party right applicable to your particular use.
CaptionPro should be treated as an assistive creative tool, not as a substitute for your own judgment.
8. Emotional, Reputational, and Other Effects of Generated Content
Generated content may occasionally contain language, suggestions, interpretations, or themes that a user finds upsetting, embarrassing, offensive, distressing, or otherwise undesirable.
To the fullest extent permitted by law, OptimizeSocial is not responsible for emotional distress, embarrassment, reputational harm, interpersonal consequences, loss of followers, negative comments or reactions, or similar consequences arising from your decision to use, publish, modify, rely upon, or share AI-generated content.
You are responsible for reviewing generated content before publishing or sharing it.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
9. No Professional Advice
CaptionPro does not provide legal, medical, mental health, financial, tax, investment, or other professional advice.
AI-generated content should not be relied upon as professional advice or used to make decisions requiring qualified professional judgment.
10. User Responsibilities
You agree not to use CaptionPro to:
- violate applicable laws or regulations;
- violate the rights of another person;
- impersonate another person without authorization;
- infringe copyrights, trademarks, privacy rights, publicity rights, or other intellectual property rights;
- generate or distribute unlawful content;
- interfere with or attempt to compromise CaptionPro's systems or security;
- reverse engineer or improperly access the service; or
- use the service in a fraudulent, deceptive, abusive, or malicious manner.
You are responsible for content you provide to CaptionPro and for ensuring that you have the necessary rights and permissions to use that content.
11. Social Media Platforms and Third-Party Services
CaptionPro may rely upon or interact with third-party platforms, APIs, data providers, payment processors, hosting providers, and other services.
Those services are outside our control.
We do not guarantee uninterrupted availability of any third-party integration or particular social media platform. Features may become unavailable or change because of modifications made by third parties.
12. Intellectual Property
CaptionPro, OptimizeSocial, our software, branding, designs, technology, and other proprietary materials are owned by us or our licensors and are protected by applicable intellectual property laws.
Subject to these Terms and applicable law, we do not claim ownership of the original content you provide to CaptionPro.
Your rights in AI-generated output may depend on applicable law and the circumstances surrounding its creation. We make no representation or warranty that any particular AI-generated output is eligible for copyright or other intellectual property protection.
13. Availability and Changes to the Service
We may modify, update, add, remove, suspend, or discontinue features of CaptionPro.
We do not guarantee that CaptionPro will always be available, uninterrupted, secure, or error-free.
14. Disclaimer of Warranties
To the maximum extent permitted by law, CaptionPro is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
We do not warrant that the service or generated content will be accurate, reliable, error-free, appropriate, uninterrupted, or suitable for any particular purpose.
15. Limitation of Liability
To the maximum extent permitted by applicable law, OptimizeSocial and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to CaptionPro or generated content.
To the maximum extent permitted by law, our total liability arising out of or relating to CaptionPro will not exceed the amount you paid to us for CaptionPro during the twelve months immediately preceding the event giving rise to the claim.
These limitations apply only to the extent permitted by applicable law.
16. Account Suspension or Termination
We may suspend or terminate access to CaptionPro if we reasonably believe a user has violated these Terms, abused the service, engaged in fraud, compromised service security, or created material risk for CaptionPro, OptimizeSocial, other users, or third parties.
17. Changes to These Terms
We may update these Terms from time to time. When required by law, we will provide notice of material changes before they take effect.
Continued use of CaptionPro after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
18. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law provides otherwise.
